1. General information

For all business between the ski school and the customers, these general terms and conditions apply exclusively.

 

2. Conclusion of contract

Reservations for private and group courses can be made through our online store, by phone, e-mail, or fax. Reservations are only definite after written confirmation by the ski school.

All offers of the ski school are subject to change. For the acceptance of a reservation or the scope of our services, our written order confirmation is exclusively decisive. Verbal or telephone promises are only legally binding after written confirmation by the ski school.

For bookings on site (private and group courses) a contractual relationship is only established with the purchase of the necessary course tickets. The course tickets are not transferable. The customer receipt must be kept and presented for subsequent bookings. Extension of the group course ticket for the difference (plus processing fee) is possible from the 3rd day. Lift tickets are not included in the course price. All our prices are inclusive of the legal sales tax. Price lists are without guarantee. We are not liable for any printing errors.

 

3. Terms of payment

If no other written agreements have been made, a deposit of 50% of the invoice amount must be paid immediately after receipt of the written order confirmation for contracts concluded via the Internet, fax or other means of remote communication with regard to private or group courses, the remainder must be paid before the start of the service. For contracts concluded on site, the fee for the service to be performed is to be paid in the ski school office.

 

4. General conditions of participation

The course participant must truthfully and comprehensively inform the ski school about his or her skiing skills and experience, and must himself or herself ensure that he or she has equipment that is appropriate to the state of the art of skiing and the external conditions. In addition, he/she must inform the ski school about his/her state of health and any health problems.

Before the beginning of the instruction, the contractual partner must independently arrange for the inspection of the ski equipment (ski bindings) by a specialized company.

The ski school declines any liability for accidents which occur during or before the lessons. The conclusion of an accident & liability insurance is the responsibility of each course participant and is recommended by the ski school.

The group division of the ski courses is done by the ski school. If a downgrading of a course participant is necessary, the course participant must accept the decision of the ski school. Otherwise the ski school is entitled to dissolve the contract.

Instructions of the ski school are to be followed by each course participant. The participation in courses in an alcoholised state or under the influence of drugs is not permitted. In this case the ski school can immediately exclude a course participant from further participation in a course without the person concerned being entitled to (partial) reimbursement of the paid course fee.

If the number of course participants in group courses is reduced to less than 4 persons, the ski school reserves the right to combine group courses or to reduce the teaching time for the remaining participants in the group.

 

5. Liability regulations

The ski school is only liable for damages which were caused by employees of the ski school deliberately or grossly negligent. A liability due to slight negligence is expressly excluded.

Every course participant is recommended to take out health, accident, liability, and foreign health insurance.

 

6. Warranty

The course participant must immediately report any complaints to the ski school office on site. Only then is there a claim to a reduction of the paid fee.

 

7. Withdrawal

A partial refund of already purchased group course tickets is only possible in case of injury or illness, which is confirmed by a medical certificate from a local doctor. No refunds will be given if a course is cancelled due to weather conditions.

Fixed booked private courses can only be cancelled until 17:00 o'clock the day before at the latest. Otherwise, the course fee must be paid for a fixed private course.

 

8. Place of jurisdiction and place of performance

The place of jurisdiction and place of performance shall be Innsbruck.

 

9. Data protection

The ski school is entitled to electronically store and process the data provided by a course participant. The ski school commits itself to store these data exclusively.

 

10. Payment

Credit card payments in favor of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement.
